End User License Agreement (EULA) for the Personalizer Program Used for Commercial Purposes

1. This License Agreement sets out the rules for using the Personalizer program and is binding upon the author of the Program and the User, hereinafter referred to as the Licensee.

2. The software is protected by copyright law and international treaties on the protection of copyright and intellectual property.

3. The subject of this License Agreement is the use of the Personalizer program, hereinafter referred to as the Program.

4. The author of the Program is TEgraf Tomasz Szafranowski, Osiedle Przylesie 14, 66-008 Wilkanowo, VAT ID PL 973 032 79 07, e-mail: info@impozycjoner.pl.

5. The sole owner of the Program, Documentation, and other materials provided with the Program, as well as all copyrights and proprietary rights thereto, is the author of the Program, hereinafter referred to as the Licensor.

6. The free 30-day trial version of the Program may be used for commercial purposes. In this version, the Program has no functional limitations.

7. The free 30-day trial version of the Program does not automatically convert into a paid version and does not incur any charges.

8. Upon expiration of the trial period, further use of the Program requires the purchase of an appropriate license or subscription available in the Microsoft Store.

9. The rules for subscription renewal are specified in the Program offer available in the Microsoft Store.

10. The license variant and the number of devices or users authorized to use the Program are specified in the terms of purchase available in the Microsoft Store.

11. Proof of lawful use of the Program is a purchase made through the Microsoft Store and the assignment of the license or subscription to the Licensee’s Microsoft account.

12. The Licensee undertakes not to attempt to derive the source code of the Program. In particular, decompilation, disassembly, reverse engineering, as well as any other forms of modification of the Program are prohibited, except where expressly permitted by mandatory provisions of law.

13. The Licensee undertakes not to copy, distribute, or use the Program or Documentation in a manner that exceeds the scope permitted by this Agreement without the consent of the Licensor.

14. The transfer of rights to use the Program may occur exclusively in accordance with the rules applicable in the Microsoft Store or with the consent of the Licensor.

15. The Licensee using the free 30-day trial version of the Program is entitled to basic technical support regarding the operation of the Program.

16. Licensees of the paid versions of the Program are entitled to receive updates provided by the Licensor and technical support provided via e-mail at info@impozycjoner.pl.

17. Matters related to payments, invoicing, subscriptions, and refunds processed through the Microsoft Store are governed by the terms and conditions of that platform.

18. Nothing in this License Agreement shall be construed as a warranty or commitment to provide future Program updates.

19. The Program is provided on an “as is” basis, without warranties of any kind, express or implied, except as required by mandatory provisions of law.

20. The Program is designed to operate under supported versions of the Windows operating system as specified in the current technical documentation of the Program.

21. To the maximum extent permitted by applicable law, the Licensor shall not be liable for any damages, including but not limited to loss of profits, loss of data, business interruption, or any other losses arising from the use or inability to use the Program, regardless of the cause. The Licensor shall also not be liable for any damages resulting from use of the Program in violation of applicable law or this License Agreement. If liability cannot be excluded, it shall be limited to the amount actually paid for the Program license.

22. In the event of a breach of this License Agreement, the Licensor has the right to terminate this Agreement and pursue all rights and claims available under applicable law.

23. For matters not covered by this Agreement, the provisions of Polish law shall apply, in particular the Act on Copyright and Related Rights, as well as the terms and conditions of the Microsoft Store platform.

24. The Program does not collect, process, or transmit any personal data of the Licensee. Any data entered by the Licensee while using the Program is processed locally on the Licensee’s device and is not transmitted to the Licensor or any third parties.

25. Personal data provided by the Licensee in connection with the purchase of the Program (such as name, e-mail address, and billing details) are processed exclusively by the Microsoft Store operator in accordance with its applicable privacy policy. The Licensor does not have access to this data, except for the e-mail address necessary for providing technical support, which is processed solely for the purpose of responding to support requests in accordance with applicable data protection law (GDPR).
